Steve, can you explain why revocable living trusts are so popular among your clients?
Certainly. Revocable living trusts offer several key advantages. First and foremost, they allow individuals to maintain control over their assets during their lifetime. This means the grantor, the person creating the trust, can still manage and even change the terms of the trust as their needs evolve.
Moreover, a revocable living trust avoids probate, which is often a lengthy and expensive legal process. Consequently, the assets in the trust pass directly to the beneficiaries upon the grantor’s death, saving time and money for loved ones.
Another significant benefit is privacy. Unlike wills, which become public record during probate, the terms of a revocable living trust remain confidential.
Potential Issues with Revocable Living Trusts
Are there any potential drawbacks or issues that individuals should be aware of when considering a revocable living trust?
While generally advantageous, it’s important to remember that a revocable living trust isn’t right for everyone. It typically makes sense for those with significant assets or complex family situations.
I recall a situation where a client initially thought a revocable living trust was unnecessary because their estate was relatively modest. However, after carefully reviewing their circumstances, including the desire to ensure their adult children with disabilities received ongoing support without jeopardizing their government benefits, we determined that a special needs trust would be more appropriate.
