If guardianship seems appropriate, then we file a petition with the court outlining the situation and the proposed guardian. We also notify interested parties like family members and close friends. The court appoints an investigator to thoroughly assess the individual’s needs and capacity. Finally, there’s a court hearing where everyone involved can voice their opinions.
Let’s Dive into ‘Court Investigation and Evaluation’. What Happens During This Phase?
Ted: This is a crucial stage where the court aims to get a clear picture of the individual’s situation. The investigator, often called a guardian ad litem, meets with the proposed ward – the person who might need guardianship – to understand their needs and wishes. They also interview family members, caregivers, and professionals involved in the individual’s life.
